Terms of Service

By accessing or using MintIT ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. You must be at least 18 years old to create an account or use the Service.

MintIT provides cloud infrastructure services, including virtual private server (VPS) provisioning, management, and related tooling. Services are provisioned through third-party infrastructure providers and are subject to their underlying acceptable use policies. By using MintIT, you agree to comply with those policies as they may apply to you.

You must register for an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it updated. We reserve the right to suspend or terminate accounts that contain false or misleading information.

You agree not to use the Service to:

• Send unsolicited bulk email (spam) or operate open mail relays;
• Conduct port scanning, vulnerability scanning, or network probing of third parties without authorization;
• Launch denial-of-service (DoS/DDoS) attacks or participate in botnets;
• Host, distribute, or transmit malware, ransomware, or other malicious code;
• Engage in phishing, fraud, fake support or impersonation scams, pyramid or ponzi schemes, or other deceptive monetary schemes;
• Mine cryptocurrency (CPU or GPU) on any provisioned resources;
• Operate TOR exit nodes;
• Operate open proxies, open mail relays, or open recursive DNS resolvers;
• Send outbound email through restricted ports without prior approval. SMTP (port 25) and similar ports may be blocked or rate-limited by default in accordance with upstream provider policies;
• Offer DDoS mitigation as a service to third parties using provisioned resources;
• Deploy autodialers, robocalling software, or any VoIP-based mass-calling tools;
• Resell, sublease, or grant third-party access to provisioned infrastructure without our written permission;
• Store or distribute child sexual abuse material (CSAM) or any content that exploits minors;
• Violate any applicable local, national, or international law or regulation;
• Infringe the intellectual property rights of any third party;
• Attempt to gain unauthorized access to any system, network, or data;
• Engage in any activity that violates the acceptable use policy of our upstream infrastructure providers, even if not explicitly listed above.

We reserve the right to suspend or terminate any service immediately and without notice for violations of this section.

We reserve the right to forward abuse reports to upstream infrastructure providers and to cooperate with law enforcement upon request. You agree to comply with such investigations.

All services are prepaid. Payment is required before a server is provisioned. We accept cryptocurrency and other payment methods as made available at checkout. Prices are displayed in USD; cryptocurrency amounts are calculated at the time of invoice creation and locked for the duration of that invoice.

Recurring services will generate a new invoice prior to expiration. Failure to pay before the expiration date will result in service suspension and, after a grace period, permanent deletion of the associated server and its data. MintIT is not responsible for any data loss resulting from non-payment.

All payments are final and non-refundable. We do not offer refunds, credits, or prorated adjustments for any reason, including but not limited to: early cancellation, unused service time, account suspension for policy violations, or service interruptions outside our direct control. Please review your order carefully before completing payment.

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled and unscheduled maintenance, third-party infrastructure issues, or events outside our control may result in downtime. We are not liable for any damages arising from service interruptions.

You retain ownership of any data you store on your servers. We do not access your server data except as required to operate and maintain the Service, comply with legal obligations, or investigate abuse reports. Our Privacy Policy, incorporated herein by reference, describes how we collect and use personal information.

You may terminate your account at any time by contacting support. We may suspend or terminate your account at our discretion for violations of these Terms, non-payment, or any activity we determine to be harmful to the Service or its users. Upon termination, your servers will be deleted and their data destroyed. No refunds will be issued for remaining prepaid time.

To the fullest extent permitted by applicable law, MintIT and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 30 days preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in San Juan, Puerto Rico, including the United States District Court for the District of Puerto Rico.
